ND Supreme Court hears disputed feedlot case

BISMARCK, N.D. (AP)--The attorney for a Morton County man says the County Commission is allowing a feedlot within a quarter-mile of where he wants to build a house.

Donald Hagerott is asking the North Dakota Supreme Court to overturn the County Commission's decision.

Hagerott's attorney, Tami Norgard, told the justices Nov. 9 that Hagerott got a permit May 1 that gave him 180 days to start building a house on the land. She said the County Commission issued a permit for the feedlot June 25.

The site is about 15 miles northwest of Mandan. The feedlot could handle up to 10,000 cattle.

Norgard said Hagerott wants to build a house for his son, Mark, who is on military duty in Afghanistan.

Morton County's attorney, Randy Bakke, argued there is no evidence Hagerott actually was going to build a house on the property.
