Judge's ruling allows poultry producers to continue best management practices

A federal judge's ruling against an injunction request by the state to halt the spreading of poultry litter in the Illinois River watershed means poultry producers can return to the science-proven method of spreading the valuable fertilizer.

"This is good news for our producers," said Mike Spradling, president of the Oklahoma Farm Bureau.

"We have always believed our producers were following the best management practices according to research that dictates the safe and accurate use of poultry litter as a valuable soil additive," Spradling said.

The judge ruled the state of Oklahoma did not meet the burden of proof that bacteria in the waters of the watershed are caused by application of poultry litter. Judge Gregory Fizzell said evidence indicates fecal bacteria could come from other sources, including the growing number of human septic tanks in the watershed.

Earlier this year the OFB Legal Foundation was granted permission by the judge to file a friend-of-the-court brief in support of the producers.

The brief outlined the science-based reasons for using poultry litter.
