"While I am pleased those who were able to sign up originally are going to be able to proceed," Senator Roberts said, "others should not be unfairly disadvantaged by a court's decision to micro manage the program."

Roberts' bill will allow producers to hay and graze CRP acres under USDA's original Critical Feed Use criteria. Senators Sam Brownback (R-KS) and James Inhofe (R-OK) are cosponsors of the bill. Congressman Jerry Moran (R-KS) has introduced similar language in the House.

Senator Roberts is a senior member of the Senate Committee on Agriculture Nutrition and Forestry.

I had an appoinment to sign up for the critical feed use program the same day the restraining order was issued. Now I cannot proceed with sign up according to the court's ruling. I am sure there are other producers in this same position that are now disadvantaged. I am happy that the Roberts' Bill has been introduced and hope that it can be processed in time for producers to take advantage of the program before it is too late in the season to do so.

I am glad to see that both the House and Senate are addressing the issue of those who intended to use the Critical Feed Use Program, but had not yet applied and had not spent $4,500 in preparation for grazing or haying. (By the way, where did that phoney baloney number come from? I can just see the attorneys sitting around, shooting the breeze and coming up with a number.) I was fortunate to have applied and been approved for the grazing program before the restraining order. But as there was, I believe, no deadline on applying, Judge Coughlin's ruling is certainly unfair to those who had not yet applied, but intended to do so.
