HPWD Board of Directors approve administrative amendments to district rulesTexas The five-member High Plains Underground Water Conservation District Board of Directors unanimously approved administrative amendments to the district's rules at their Aug. 12 regular meeting. Board members did not receive any negative comments regarding the proposed rule amendments during public hearings held Aug. 5 in Hereford and Aug. 7 in Lubbock. In addition, no written comments were received from the public when the comment period ended Aug. 11 at 5 p.m. This rule revision includes introduction of a new printed format and addition of new procedural rules resulting from the passage of House Bill 1763, now codified as Chapter 36.108 of the Texas Water Code, and other legislation. Most of the recent amendments are contained in the following sections of the rules: --Rule 3.6: Drilling and operation of illegal wells: Citizen Suit. (SB 1383). --Rules 9.1 to 9.12: Permit hearing procedures (HB 1763). --Rule 10: Rulemaking hearing procedures (HB 1763). "The High Plains Water District has operated under these rule provisions since the passage of SB 1383 and HB 1763; however, specific statutes were not cited in the rules. We have included them so that district constituents do not have to locate these statutes in law books or other resources. It is hoped that this will make our rules more user-friendly," said District Manager Jim Conkwright. Conkwright said additional rule amendments are likely later this year. "Public meetings were held in each of the five district directors' precincts in February and March 2008. The next group of proposed rule amendments is based upon comments and concerns provided to the board by residents attending those meetings," Conkwright said. Created in 1951, the High Plains Underground Water Conservation District No. 1 provides for the conservation, preservation, protection, recharging, and prevention of waste of groundwater stored in the Ogallala aquifer within its service area.
