Ag interests move to intervene in suit to list mountain ploverColorado On March 13, three prominent agricultural organizations filed motions to intervene in litigation brought by environmental groups to list the mountain plover under the Endangered Species Act. The Colorado Cattlemen's Association, Colorado Farm Bureau and Wyoming Stock Grower's Association oppose the listing and seek to represent the interests of agriculture, landowners and their lessees in the suit in the U.S. District Court in the Southern District of California. Forest Guardians and Biodiversity Conservation Alliance are behind the lawsuit. Forest Guardians also filed suit to list the Gunnison sage grouse, Gunnison prairie dog and black-tailed prairie dog, among others. The mountain plover's summer range includes large portions of Colorado, Wyoming and New Mexico. If listed, landowners and businesses throughout its range could face onerous regulatory restrictions that affect economic productivity and good land stewardship. "Innovative voluntary conservation efforts are already protecting the mountain plover in Colorado," said Troy Bredenkamp, Executive Vice President of the Colorado Farm Bureau. The ESA was signed into law in 1973, and was designed to bring endangered species back from the brink of extinction. Over the past 35 years, according to the U.S. Fish and Wildlife Service, only a handful of over 1300 species on the ESA's list have recovered. "Study after study shows the ESA simply doesn't work," said Kenny Rogers, President of the Colorado Cattlemen's Association. "Less than 1 percent of all listed species have ever been recovered, and the mountain plover deserves better than the bureaucracy of the ESA," added Jim Magagna, Executive Vice President of the Wyoming Stock Grower's Association. The Cattlemen's, Farm Bureau and Stock Growers are represented by Holsinger Law, LLC, based in Denver, Colorado.
